The Noncompliance Conference

While license revocation does not always follow a non-compliance conference, it happens often enough that RCFE owners should be greatly concerned if they receive a non-compliance conference letter.

The non-compliance conference is a meeting during which the regional CCL office & RCFE licensee review outstanding issues, deficiencies and plan for correction. For the RCFE licensee this meeting is an excellent opportunity to clarify which deficiencies are the most concerning to the LPA, LPM and regional office.

When attending the non-compliance conference the RCFE licensee and attorney should be prepared to present a plan for correction relating to all issued citations over the past 3 years. This may sound like a daunting task, but it is important to convey the licensee’s desire and ability for continued compliance. If the Regional Office believes compliance is not realistic or likely they may (and often do) refer the matter to the DSS Legal Division for revocation of the RCFE license.

After the non-compliance conference the RCFE licensee should receive a Noncompliance Conference Summary by mail. The summary will identify the members in attendance, deficiencies discussed, actions agreed to be undertaken by the licensee by certain dates to bring the facility into compliance, and consequences for failure to take the aforementioned actions.
